Industrial Disputes Act, 1947 – Employer Employee Relationship – Agreement between Employer and Agency –  the Labour Court took notice of documents like attendance register/duty chart, copy of the joining report, salary payment register, etc. and then arrived at the conclusion with respect to the employer-employee relationship. The agreement would not by itself be a determinative factor as the Employee is not a party to the agreement. The factual finding of the Labour Court is comprehensive and requires no interference.
