Contempt of Court – If it is a fact that the District Magistrate was away on tour and was not aware of the order of the High Court, that fact must be regarded as a good defence in a contempt proceeding – If there was no intention to flout or disobey the order of the High Court that must also be regarded as an important circumstance.
